BDSM is fine (AFAIK) from consensual age here… The spanner case was not about BDSM but more the single act of physical harm on another.

As it stands, ABH is classed as greater than superficial, needing stiches. For the most part, the activities carried out in the Vampire community (and the Spanner case in particular) are not usually to this extreme. However, you can, and WILL be prosecuted for ABH, should charges be pressed.

Having consent from a partner does NOT clear you. The charge of ABH will be brought regardless of whether they are willing or were forced. If the partner DOES give evidence that the act was with consent, then they too could be charged with “aiding and abeiting” (how fucked is our legal system??) of ABH on themselves.

The point is that you clearly shouldn’t be doing this with someone you don’t trust absolutely. All it would take is for someone to wander to the police station, give a statement and show the marks for you to be carted off.

BDSM in general, is fine … just as long you don’t leave marks (bruises, cuts,etc).

Maybe it’s because a charge against someone doing possible physical harm on someone under 18 would be more serious legally, or just because it can get so much bad press? I don’t know. Ugh.

Damn dangerous thing to do then. Yep, we have one hell of a fucked up legal system… Aiding and abetting physical harm on YOURSELF? What the hell. 👿

most just figure when you’re 18 you can finally decide for yourself without beeing influenced by others, which is shit of course

just because you can drive a car and drink beer you wont have any more control over yourself and your actions than before – they just see it as a good age to “start” allowing it as 14 would be too young and 30 too old by most definitions. afaik and believe noone would charge two consenting adults who harmed each other if they did that in free will of the one harmed (more people..one way harming.etc too this was ju7st an example.)

abuse is only happening when someone is either harmed without his consent or is not in the position to decide with a clear mind for himself at the moment of the consent – might it be out of drug influence or age, or whatever.

but its that uncertainity that keeps bdsm underground..

if it was clearly forbidden by law you wouldnt find clubs for it, if it was clearly ruled legal we wouldnt have this discussion now

in germany its legal as long as consenting adults carry it out but im not 100% certain there

Not sure about the laws in Germany, but as I said, BDSM itself is fine, however English law still doesn’t recognise consensual mutilation for sexual gratification as being distinct from hacking at someone with an axe.

As for the 18 thing, I think that’s more to do with a percieved “ok” ness involved as then they are technically an adult. Of the few fetish clubs I know, the age limit ranges from 21-25. Would help if you could say where you got the figure from, websites, magazines, tv.. etc, as AFAIK the law doesn’t actually specify an age, merely using the term “of legal age”, refering to the age of consent (currently 16)… of course, my knowledge is VERY limited on the subject and have only a glancing knowledge of the law surrounding BDSM and sexual practises.

when you’re 18 over here youre allowed everything..the only upper step on the ladder is 21 but this is only applying to crime charges as it’s the final limit to which youth crime charges can be applied i think.

other than in the us at least you can drink with 16 and drive cars ( buy porn, drink heavy liquor…) only from 18 on.

so there are no “society don’t”s from 18 on, 21 nearly plays no role at all.

i think most clubs handle it that way too.

but then its even a crime to stomp a consenting adult an axe into his/her shoulder…same trickyness as i mentioned before… its more a case-to-case thing.

In continental Europe for example it usually is no problem at all for you to view pages that offer information – even if it’s sexually related information. In South America on the other hand anything in the erotic power exchange area is considered illegal at any age. In Australia and New Zealand there is no problem reading these pages if you are over 21, and most Asian countries actually could not care less as long as you are over 16. (Note: recent changes in Australian laws means you should look into this yourself if you live there.)

If this is true.. I’ve broken this three times so far, or even many more times due to my inquisitive nature while of the age of twelve…*grins*

I’ll keep breaking this law until I die or am are over the age….! :fuck: :whip:
